UNA CONTRACULTURA / IN FEMINICIDIO
Era un pomeriggio di aspettativa che ogni mese le donne si incontravano per esporre le loro vite, i dolori e gli amori facevano parte di un gruppo come tanti altri e varie parti della città e del mondo.
Sono venuti a consolarla, cercare di incoraggiamento per la loro vita duri stanchi della routine che uccide i bambini, la disoccupazione, l’alcolismo compagni la povertà e il dolore e la sofferenza che portava al di là della stigmatizzazione delle donne vittime di abusi e violentata nel loro amore e relazioni affettive molti già segnato nella carne e ferito dalla violenza spesso sofferto.
Le docce non solo il cuore, ma anche di emozione male il disprezzo viola orrore nei loro corpi pieni di tagli e lividi vittime così spesso il governo stesso, che non ha dato sempre il benvenuto, non si sentivano protetti o come le donne e gli o cittadini. Sottomesso in un mondo maschile per vivere nell’ignoranza della loro classe e condizione.
E ‘stato un pomeriggio che, dopo un conto di un altro pugni notturni, calci, schiaffi e tentato omicidio che Lindinalva riferito che era stanco di questo mondo e della vita e fatto capire che la prossima volta sarebbe o uccidere il dado non è più sopportare di loro figli piangendo, piangendo, supplicando il padre che non colpisce sua madre con le promesse di un giorno, crescerò e tutto cambierà.

Due settimane dopo le 4 del mattino sentire urla e bambini che piangono l’umile casa dove ha vissuto i vicini hanno chiamato la polizia che all’arrivo la trovò con le sue labbra sanguinanti, vestiti strappati gli occhi gonfi di pugno che aveva avuto compagno ( marito) e bambini spaventati dalla paura e dallo shock.
E ‘stata presentata alla stazione di polizia di rapporto della polizia, ma non farsi prendere, ma quello a tarda notte perché non c’era alcun precedente è stato rilasciato e ha trascorso un paio di notti nel mondo o in casa di parenti e amici.
Dopo una settimana o giù di lì di nuovo è venuto a vedere i bambini e siamo finiti e sì seguita giorno in quella che sembrava una pace fugace in cui tutto il passato è stato dimenticato, così come i segni e lividi già vissuto e emotivamente ferito.

È andato in ospedale è morto non solo aveva una ferita nei timpani e ora solo un buon ascolto da un lato il lato della solitudine abbandonato dalla moglie e figli è stato portato in un rifugio e dopo trasmessi ai parenti a casa in un altro stato.
Quando è successo nuovamente il gruppo e la relazione della Lindinalva diffuse dell’incidente un’altra donna che apparteneva al gruppo ha riportato il seguente mai sentito sua madre dire che era un fatto noto la regione nord-orientale si è trattato di donne che sono state molto abusata dal marito erano soliti riferire che un giorno avrebbero versato acqua bollente nelle orecchie dei loro mariti mentre dormivano.
Io non cerco di conoscere le notizie o statica per il suo stesso figlio di Pernambuco madre che aveva riferito la stessa sorte agli uomini che hanno abusato solo confermare questo e mettere in chiaro che questa non è una storia di odio e di vendetta o, ma solo uno un racconto di una tradizione che mi sembra sia stata disseminata a causa della mancanza di politiche pubbliche e in difesa delle donne, ora coperta dalla legge Maria da Penha e dalle stazioni di polizia femminile e da altre leggi complementari. @ mauriciopartyguy / perché la vita conta.

EMBARGOS DE DECLARAÇÃO

I – DOS FATOS

Trata-se de ação de. Interdição interposta pelo (a) embargante, em face de ação ajuizada pela Sra. Matilde Maria da Silva Santos contra a Sra. Maria Josefa da Silva (progenitora) na qual solicita guarda e curatela em fase de sua idade e também da doença constatada.

O processo tramitou regularmente, e, ao final, este Excelentíssima Juíza proferiu a sentença de fls…, a qual apresenta omissão na fundamentação, tendo em vista que não foi consultado ou recebi citação com respeito a este fato, fui sabedor pela própria autora como forma de punição a minha pessoa. Na qual contestei nos autos sendo inicialmente acolhido como parte interessada no primeiro momento, mas. Tendo minha defensora pública nada entregue aquele cartório e ainda havia solicitado uma oitiva o que nunca se realizou ou foi a minha pessoa respeitada. Então protocolei na qualidade de Assistente Social (não ativo) documentos que corroborava minha tese, mas, fui desqualificado pela prerrogativa jurídica do estatuto e regulação OAB como sendo direito da classe advocatícia este fato.

Destarte, a sentença fora prolata ao dia.04 do mês. Julho 2018.do ano. Gerando assim grave desconforto à minha parte quanto à consequente efetividade da decisão judicial, como se verá a seguir.

II – DA TEMPESTIVIDADE

FAÇO DECLARAR QUE PRIMEIRO HÁ PROCESSO DE INVENTÁRIO DE 05/2002 AINDA NÃO CONCLUIDO POR MIM DESARQUIVADO, SEGUNDO A DOAÇÃO FEITA POR MINHA MÃE A INTERDITADA ANTES DA INTERDIÇÃO FEITA POR ESTÁGIARIA DE ADVOCACIA POR MIM ASSINADA, MAS, NUNCA ENTREGUE DIVISÃO MATERIAL DE TERRENO PARA MIM E MEU OUTRO IRMÃO.TERCEIRO POR AGRESSÃO QUE SOFRI E RELATEI AO CNJ E AINDA STF E APÓS A ÚLTIMA FIM BOLETIM POLICIAL. E AINDA O, MAS, GRAVE E QUE DECLAREI E DECLARO QUE NOS ULTIMOS 10 ANOS TOMEI CONTA DE SRA. MINHA MÃE E AINDA DO SEU PATRIMONIO (FISICO) NÃO NEGOO CUIDADO DE MINHAS IRMÃS QUANTO AO CUIDADO MÉDICO. MAS, SOU CUIDADOR DE IDOSOS COM FORMAÇÃO NOS ESTADOS UNIDOS ONDE MOREI E TRABALHEI.

Conforme o texto processual civil pátrio, o prazo para oposição de embargos declaratórios é de 5 (cinco) dias.

Art. 1.023. Os embargos serão opostos, no prazo de 5 (cinco) dias, em petição dirigida ao juiz, com indicação do erro, obscuridade, contradição ou omissão, e não se sujeitam a preparo.

Haja vista a intimação da parte autora da sentença à data de 21/09/2018 edição 2664 fls.154/TJSP, tendo transcorrido o total de 30 dias, a presente peça encontra-se tempestiva. Em publicado eletrônica ainda declaro que o advogado por mim contratado em 18/06 apenas para entregar e fazer chegar a Sra. Juíza para que ela se interpreta sua sentença ao final e a luz de verdade da documentação anteriormente protocolada por minha pessoa conforme o já exposto.

III – DO DIREITO

Como é cediço em Direito, para alcançar o fim a que se destina, é necessário que a tutela jurisdicional seja prestada de forma clara e completa, sem obscuridade, omissão ou contradição. A própria Carta Magna faz menção à obrigatoriedade da exposição das motivações judiciais:

Art. 93. (…) por todo o exposto acima fica evidente da arbitrariedade desta sentença e ainda a omissão de procedimentos básicos legais já que minha advogada não contestou veementemente em meu nome o que agora solicito através deste ato de embargo para poder dar continuidade ao inventário legitimamente direito meu e para que seja de conhecimento público, pois, fui gravemente desrespeitado por meus familiares e até outros que nada sabem desta natureza.

IX – todos Os julgamentos dos órgãos do Poder Judiciário serão públicos, e fundamentadas todas as decisões, sob pena de nulidade, podendo a lei limitar a presença, em determinados atos, às próprias partes e a seus advogados, ou somente a estes, em casos nos quais a preservação do direito à intimidade do interessado no sigilo não prejudique o interesse público à informação; (grifo nosso)

Também é reforçada tal obrigatoriedade no âmbito cível através do artigo 489 do Código de Processo Civil:

Art. 489. São elementos essenciais da sentença:

(…)

II – Os fundamentos, em que o juiz analisará as questões de fato e de direito;

(…)

• 1º Não se considera fundamentada qualquer decisão judicial, seja ela interlocutória, sentença ou acórdão, que:

I – Se limitar à indicação, à reprodução ou à paráfrase de ato normativo, sem explicar sua relação com a causa ou a questão decidida;

II – Empregar conceitos jurídicos indeterminados, sem explicar o motivo concreto de sua incidência no caso;

III – invocar motivos que se prestariam a justificar qualquer outra decisão;

IV – Não enfrentar todos os argumentos deduzidos no processo capazes de, em tese, infirmar a conclusão adotada pelo julgador;

V – Se limitar a invocar precedente ou enunciado de súmula, sem identificar seus fundamentos determinantes nem demonstrar que o caso sob julgamento se ajusta àqueles fundamentos;

VI – Deixar de seguir enunciado de súmula, jurisprudência ou precedente invocado pela parte, sem demonstrar a existência de distinção no caso em julgamento ou a superação do entendimento.

O dispositivo retro mencionado configura-se de tamanho apreço pelo sistema jurídico que é, no novo Código Processual Civil, embasamento para o chamado “Princípio da Motivação das Decisões”, consistindo esse último, segundo Neves (2017)1, na “exteriorização das razões de seu decidir [do juiz], com a demonstração concreta do raciocínio fático e jurídico que desenvolveu para chegar às conclusões contidas na decisão”.

Ainda, o próprio CPC reforça a magnânima importância do presente princípio ao dispor expressamente que o juiz deve se ater à expressão da fundamentação judicial de forma clara e precisa.

In the nineties here in São Paulo, but specifically in the neighborhood of Liberdade I was invited by a friend Monique to work with prostitutes under the aspect of social inclusion and also the idea of ​​social equality for these women who has no access to anything. Work from the point of view of citizenship that respected her role as a woman within society and whether or not she was aware of it. I have to remind everyone that they are important social issue because, under the filter of judgment not only by other so-called “normal” women, the marginalized women are due to low wages, abandonment of the husband, personal choice for a social ascent within society global and capitalist or even from the street and drug situation. We did not care about her personal or professional history, but we wanted and would like to give this woman options for different paths and paths from her own condition and still possibility and fragility within this same patriarchal, sexist and socially full society of preconceptions and modesty. My work consisted of holding a reflection meeting, group discussion, group dynamics and English classes. I will get a material with an English / USP teacher. And from there he performed the above work with the group. This being a work done by an NGO that was funded by the state government, after 03 months came to an end because the technicians informed me that 1 prostitute did not need English classes, 2 my curriculum was not enough since it was neither skill in English or had an equivalent degree and pedagogically was not a priority of the government at the time, there were, as there are always social issues more urgent and deserving of that amount. Then the work came to an end, but during English learning that was useful because some liked to understand another language and we still knew that it could be important to those who had contact with foreigners. (Our Thinking), as well as producing moments of citizenship, relaxation and self-reflection. Good English lessons yielded some content and one of the most asked questions was for these women what the translation and meaning of Imagine (John Lennon) was. So as preparation for the closure of that moment that to have today I have present in my heart we follow the following steps first we read, as we discuss each paragraph and possibility and interpretation and its world view.
